Fees

The Law Office of Gary E. Gill, P.S. charges the following fees for the services described. Some of the fees listed are estimates only. Each client matter is unique and, therefore, the legal fees charged to complete some projects may be greater than described below if the issues are more complex. In some circumstances, the fees charged will be less with simpler projects. We spend time with our clients throughout the process to make sure they understand their fees prior to incurring the cost. Standard Estate Plan Fee (estimate only):

The standard estate plan includes meeting with clients and drafting and execution of a Will, Powers of Attorney for Financial and legal affairs, Power of Attorney for Health Care Decisions, Health Care Directive, Community Property Agreement and Disposition of Remains.  Also includes a detailed letter discussing your estate planning documents, beneficiary designations for life insurance and retirement accounts, and overall estate planning strategy.  The fees below for a couple or individual with a minor child(ren) include a trust for the minor child(ren).  A standard estate plan is for estates that do not require estate tax planning.

Any non-standard or involved drafting (including certain circumstances where there are children from a prior marriage or drafting a revocable living trust) will increase the fees estimated below.  The following fees require that client receive all drafts and correspondence by e-mail (final documents will be hardcopy printouts and the originals will be provided to clients after execution).

  • Couple with Minor Children: $1,700 to $2,100
  • Couple without Minor Children: $1,500 to $1,800
  • Individual with Minor Children: $1,300 to $1,600
  • Individual without Minor Children: $1,000 to $1,200

 

Estate Plan for Taxable Estates Fee (estimate only):

The estate plan for taxable estates includes meeting with clients and drafting and execution of a Will, Powers of Attorney for Financial and legal affairs, Power of Attorney for Health Care Decisions, Health Care Directive, Community Property Agreement, Disposition of Remains, a credit shelter trust, and a marital trust.  Also includes a detailed letter discussing your estate planning documents, beneficiary designations for life insurance and retirement accounts, and overall estate planning strategy.  The fees below for a couple or individual with a minor child(ren) include a trust for the minor child(ren).

Any non-standard or involved drafting (including certain circumstances where there are children from a prior marriage or drafting a revocable living trust) will increase the fees estimated below.  The following fees require that client receive all drafts and correspondence by e-mail (final documents will be hardcopy printouts and the originals will be provided to clients after execution).

  • Couple with Minor Children: $2,800
  • Couple without Minor Children: $2,400

 

Additional Trusts:

Billed hourly at $275 per hour (estimate of cost provided to client prior to drafting).

Legal Documents to Deal with the Possibility of a Disability:

Power of Attorney for Financial and Legal, Power of Attorney for Health Care Decisions, Power of Attorney for Minor Children, and Health Care Directive.

  • Couple: $600 (estimate)
  • Individual: $400 (estimate)

 

The cost of probate is broken down into the following two categories: Attorney Fees and Fixed Costs.

 

Attorney Fees:

The legal fees to probate an estate depend largely upon the issues to be addressed and the complexity of the estate.  All work is billed on an hourly basis with Attorney fees of $275 per hour and Paralegal fees of $115 per hour.  Generally, our office can complete a non-taxable probate with legal fees between $3,000 and $5,000.  If matters arise during a probate that require additional administration, the cost of the legal fees will increase accordingly.

Fixed Costs:

  • Court Filing Fee: $240
  • Letters Testamentary $5 each (typically total $25-$50)
  • Publication of Notice to Creditors: $108 (in King County)

 

Representing trustees or beneficiaries in the context of reviewing, drafting or revising trust documents.

  • Principal Attorney rate: $275/hour
  • Paralegal rate: $115/hour

 

Representing Personal Representatives or beneficiaries/heirs in the context of a probate or trust dispute.

  • Principal Attorney rate: $275/hour
  • Paralegal rate: $115/hour
Cost to Incorporate - the cost to incorporate a business is broken down into the following two categories: Attorney Fees and Fixed Costs.
 

1. Corporation

Attorney Fees:

The Law Office of Gary E. Gill charges between $1,150 and $1,250 for attorney fees to incorporate a business for a client.  This fee includes the following services: meeting with the client for the first hour (if additional time is desired, client pays at the appropriate hourly rate), preparing the incorporation documents (Articles of Incorporation, Consent of Shareholders, Consent of Board of Directors, Bylaws, Consent in Lieu of Initial Meeting, Stock Subscriptions), filing the Articles of Incorporation, obtaining a federal tax identification number (EIN), and drafting a detailed letter to the client regarding the process of incorporating the business.  The cost of preparing a shareholders’ agreement is an additional charge and the cost varies depending on the complexity of the drafting considerations.  If matters arise during the incorporation process which require additional attorney time, the cost of the legal fees will increase accordingly.

Fixed Costs
(the following are the current costs charged by the State of Washington):

  1. Secretary of State Filing Fee: $200 (online filing)
  2. Master License Application Fee: $15
  3. Initial Annual Report: $10

There may be additional registration and license fees associated with the Master License Application depending on the nature of your business.

Additional legal work for small business such as negotiating and drafting business contracts and commercial leases, advising clients on landlord-tenant issues and advising clients on the dissolution of businesses and partnerships.

  • Principal Attorney rate: $275/hour
  • Paralegal rate: $115/hour

 

2. Limited Liability Company

Attorney Fees:

The Law Office of Gary E. Gill charges between $1,050 and $1,150 to incorporate an LLC for a client.  This fee includes the following services: meeting with the client for the first hour (if additional time is desired, client pays at the appropriate hourly rate), preparing the following documents (Certificate of Formation, the Consent in Lieu of Meeting of Members, and the Certificate of Interest of Member), obtaining a federal tax identification number (EIN), and drafting a detailed letter to the client regarding the process of creating the LLC.  The cost of preparing an LLC Operating Agreement is an additional charge and the costs vary depending on the complexity of the drafting considerations.  If matters arise during the incorporation process which require additional attorney time, the cost of the legal fees will increase accordingly.

Fixed Costs
(the following are the current costs charged by the State of Washington):
